Customer services
These general terms explain Broadlink’s commercial service framework. They do not replace the signed Service Order, Master Service Agreement, service-specific schedule, acceptable use policy, or required disclosures delivered with a final proposal.
1. Business customer and authorized representatives
Services are offered for business, organizational, and public-sector use unless a Service Order says otherwise. The person accepting an order represents that they are authorized to bind the customer. The customer must keep billing, service-location, technical-contact, and emergency-location information accurate.
2. Orders and service review
A request, website form, budget estimate, or verbal discussion is not an accepted order. Broadlink may require address validation, engineering review, building access, permits, construction, compatible equipment, deposits, or other prerequisites. An order becomes binding only when accepted as described in the signed documents.
If the service review shows that a quoted design is unavailable or materially different, Broadlink may propose a revised design, price, or schedule. The customer may decide whether to accept that revision subject to the signed order process.
3. Installation and customer premises
The customer must provide timely site access, a safe working environment, accurate demarcation and wiring information, power, grounding, rack space, pathways, landlord approvals, and other items assigned to it in the service design. Installation dates are estimates until confirmed. Delays caused by access, construction, permitting, utilities, customer equipment, or third parties may change the schedule.
4. Charges, taxes, and billing
Recurring charges, one-time charges, usage charges, equipment charges, taxes, regulatory assessments, surcharges, and payment timing are stated in the applicable Service Order or invoice. Unless the signed agreement says otherwise, the customer must identify a good-faith billing dispute promptly and pay undisputed amounts when due. Broadlink may correct billing errors and apply lawful late, collection, restoration, or returned-payment charges described in the signed documents.
5. Service term, renewal, changes, and cancellation
The initial term, activation trigger, renewal method, cancellation rights, and any early termination charges are established in the Service Order. Moving, changing, or disconnecting a service may require a new service review and may affect pricing, term, equipment, telephone numbers, or availability.
6. Customer use and security
The customer is responsible for authorized users, credentials, local networks, devices, content, calling activity, traffic, and compliance with the Acceptable Use Policy. The customer must use reasonable security controls and promptly report suspected fraud, compromise, unauthorized calling, or service abuse. Broadlink may take proportionate protective action when necessary to address fraud, threats, unlawful use, or material network harm.
7. Equipment and software
Ownership, maintenance, return, replacement, and risk-of-loss terms for equipment are stated in the order. Customer-owned equipment must remain compatible and properly configured. Software, Microsoft services, unified communications platforms, and other third-party products may require separate end-user or licensing terms.
8. Maintenance, interruptions, and service levels
Communications services can be affected by maintenance, power loss, customer networks, equipment, construction, third-party facilities, severe weather, emergencies, cyber events, and other conditions. Broadlink will use the operational practices stated in the signed documents. No service-level agreement, restoration time, uptime commitment, or service credit applies unless it is expressly included in an accepted service schedule or Service Order.
9. Voice, emergency calling, and number portability
Broadlink Voice customers must follow the Broadlink Voice & 911 Notice, maintain accurate registered locations, and understand that digital voice may not operate during power, broadband, local-network, or equipment failures. Telephone-number assignment and porting depend on eligibility, accurate records, authorization, and applicable industry processes. A requested number is not guaranteed until confirmed.
10. Privacy and confidential information
Broadlink handles personal information and Customer Proprietary Network Information as described in the Privacy & CPNI Notice. Each party should protect the other’s nonpublic business information and use it only for the relationship, subject to lawful disclosures and the signed agreement.
11. Suspension and termination
Subject to applicable law and signed terms, service may be suspended or terminated for nonpayment, fraud, unlawful use, material security threats, repeated or serious acceptable-use violations, unsafe conditions, or a material uncured breach. When practicable, Broadlink will provide notice and an opportunity to cure. Immediate protective action may be necessary for emergencies, fraud, security threats, or legal requirements.
12. Warranties, remedies, and liability
Service-specific warranties, exclusive remedies, service credits, liability allocations, indemnities, insurance requirements, dispute procedures, and governing law must be stated in the signed customer agreement. Public website language does not create an additional warranty, service level, or remedy. Nothing excludes liability or rights that applicable law does not permit the parties to exclude.
